Welcome to Etched by Fire. These Shop Terms explain the rules for using this website and purchasing products from my shop. By accessing the shop or placing an order, you agree to these terms. If you do not agree, please do not use the shop.
ABOUT ETCHED BY FIRE
Etched by Fire creates handmade wood-burned products. Each piece is individually burned by hand no laser involved. Because the products are handmade and may include natural wood, every item may have variations in grain, color, knots, live edges, texture, and burned detail. These variations are part of the character of handmade work and are not considered defects.
PRODUCT INFORMATION
I make every effort to describe products accurately and display colors and details as clearly as possible. However, colors may appear differently depending on your device or screen.
Product dimensions are approximate. Please review the product description, photos, measurements, materials, and personalization details before placing an order.
CUSTOM AND PERSONALIZED ORDERS
For custom or personalized orders, you are responsible for providing accurate names, dates, spelling, wording, and design details. Please review all information carefully before approving your order.
Custom and personalized items are made specifically for you and may not be canceled, returned, or exchanged once design or production work has begun, except when the item arrives damaged or I make an error.
I may contact you if clarification is needed before beginning your order. If I do not receive the information needed to complete the order, production may be delayed.
ORDERS AND ACCEPTANCE
Placing an order is an offer to purchase the selected products. An order is accepted when payment has been processed and I confirm the order.
I reserve the right to refuse or cancel an order for reasons including product availability, pricing or listing errors, suspected fraud, inability to obtain required information, or other circumstances that prevent me from completing the order. If I cancel an order after payment has been received, I will issue a refund for the amount paid.
PRICES AND PAYMENT
Prices are listed in the currency shown at checkout and may change without notice. The price charged is the price displayed when the order is placed, except in the case of an obvious pricing or listing error.
Payment must be received before an order enters production or is shipped. Payments are processed through third-party payment providers. Etched by Fire does not store full credit card information.
You are responsible for providing accurate billing and shipping information and for any applicable taxes, duties, customs fees, or other charges imposed by your location.
PRODUCTION AND SHIPPING
Ready-made items are generally ship next cusiness day after payment is received.
Custom and personalized items are generally completed and shipped within 1-2 weeks after all required details are confirmed and payment is received.
Shipping times are estimates and may vary because of carrier delays, weather, holidays, customs processing, or other circumstances outside my control. I am not responsible for delays caused by an incorrect address, carrier issues, customs, or events beyond my reasonable control.
Please make sure your shipping address is correct before placing your order. If an order is returned because of an incorrect or incomplete address, additional shipping charges may apply.
RETURNS, REFUNDS, AND EXCHANGES
Ready-made items may be eligible for return under the Etched by Fire Return & Refund Policy. Custom and personalized orders are final sale unless they arrive damaged or contain an error made by me.
If your order arrives damaged or incorrect, contact me within 3 days of delivery and include clear photos of the item and packaging. I will review the issue and, when appropriate, provide a replacement, repair, or refund.
Approved refunds are issued to the original payment method after the returned item is received and inspected. Original shipping charges are generally nonrefundable unless the item was damaged, defective, or incorrect.
INTELLECTUAL PROPERTY
All shop content, including product photographs, designs, artwork, logos, text, graphics, and branding, belongs to Etched by Fire or is used with permission. You may not copy, reproduce, modify, distribute, sell, or use shop content for commercial purposes without written permission.
Unless you request otherwise before placing your order, I may photograph completed work for my records. I will not use photos or details of your custom order for marketing without your permission.
USER-SUBMITTED CONTENT
If you submit photographs, text, artwork, or other materials for a custom order, you confirm that you have the right to provide them and that their use will not violate another person’s rights.
You give Etched by Fire permission to use submitted materials only as reasonably necessary to design, create, fulfill, and provide customer service for your order, unless you provide additional permission for another use.
PROHIBITED USES
You may not use the shop to violate any law, infringe another person’s rights, submit fraudulent information, interfere with the shop’s operation, attempt unauthorized access, or place orders using stolen or unauthorized payment information.
PRIVACY
Personal information is handled according to the Etched by Fire Privacy Policy. By using the shop, you acknowledge that information may be collected and used as described in that policy.
THIRD-PARTY SERVICES AND LINKS
The shop may use or link to third-party services, including Big Cartel, payment processors, shipping providers, analytics services, and social media platforms. These services have their own terms and privacy policies. Etched by Fire is not responsible for the content, policies, security, or practices of third-party services.
DISCLAIMERS AND LIMITATION OF LIABILITY
The shop and its products are provided to the extent permitted by applicable law. I do not guarantee that the shop will always be available, error-free, or free from harmful components.
To the fullest extent permitted by law, Etched by Fire will not be responsible for indirect, incidental, special, or consequential losses arising from use of the shop or purchase of products. Nothing in these terms limits rights or protections that cannot legally be excluded.
FORCE MAJEURE
I am not responsible for failure or delay caused by events beyond my reasonable control, including natural disasters, fire, severe weather, illness, labor disruptions, supply shortages, carrier delays, government actions, internet outages, or other emergencies.
CHANGES TO THESE TERMS
I may update these Shop Terms from time to time. The updated version will be posted with a new effective date. Your continued use of the shop or placement of an order after changes are posted means you accept the updated terms.
